The Government of the Hong Kong Special Administrative Region (HKSAR) published two regulations; The first one covers the 2019 Yemen Regulation and the Repeal Regulation. The second one covers the 2019 CAR Regulation.
#1 The 2019 Yemen Regulation and the Repeal Regulation were gazetted and came into effect on 12 July 2019
Specifically, the Regulation gives effect to certain decisions in Resolution 2216 (2015) and Resolution 2456 (2019) adopted by UNSC on 14 April 2015 and 26 February 2019 respectively by providing for the prohibition against:
- the supply, sale, transfer or carriage of arms or related materiel to certain persons or entities;
- the provision of technical assistance, training or financial or other assistance related to military activities in certain circumstances;
- making available to, or for the benefit of, certain persons or entities any funds or other financial assets or economic resources;
- dealing with funds, or other financial assets or economic resources belonging to, or owned or controlled by, certain persons or entities; and
- entry into or transit through the HKSAR by certain persons.
In addition, the UN Sanctions (Yemen) Regulation 2015 was withdrawn by the Repeal Regulation on the same day when the 2019 Yemen Regulation came into operation.
#2 The 2019 CAR Regulation (Central African Republic) came into effect on 31 May 2019
The said Regulation gives effect to certain decisions in Resolution 2454 (2019) adopted by the UNSC on 31 January 2019 by providing for the prohibition against:
- the supply, sale, transfer or carriage of arms or related materiel to the Central African Republic;
- the provision of technical assistance, training or financial or other assistance related to military activities in certain circumstances;
- making available to, or for the benefit of, certain persons or entities any funds or other financial assets or economic resources;
- dealing with funds, or other financial assets or economic resources belonging to, or owned or controlled by, certain persons or entities;
- entry into or transit through the HKSAR by certain persons.
Concerning both regulations, the HKSAR recommends
Shipowners, ship managers, ship operators and masters of Hong Kong registered ships should abide by the regulations mentioned above.
