MPA Singapore Circular 07/2014
MPA Singapore has issued circular to provide owners, operators and master of Singapore ships updates on the MLC 2006 certification process and issuance of DMLC Part 1.
The DMLC consists of two parts. The DMLC Part I is prepared and issued byMPA and contains the national requirements on the MLC. The DMLC Part II is to beprepared by the shipowner and contains the measures to ensure compliance withthe DMLC Part I.
A Maritime Labour Certificate shall be issued to a ship after verification, viainspection, that the ship (including its DMLC Part II) is in compliance with national requirements (as detailed in the DMLC Part I) and applicable MLC requirements.MPA has authorised our Recognised Organisations (ROs) to conduct the inspectionsand to issue the Maritime Labour Certificate, on behalf of MPA.
Transitional arrangement pending full certification
As part of the implementation of the MLC for the Singapore fleet, MPA hadadopted transitional arrangements while Singapore’s national laws and regulationswere being promulgated, as detailed in MPA Shipping Circular No. 08 of 2013.
Under the transitional arrangements, a transitional ship-specific DMLC Part Ihad been issued to all applicable Singapore ships by MPA for the shipowner to drawup the DMLC Part II, and obtain a Statement of Compliance to demonstratecompliance with the MLC.
Declaration of Maritime Labour Compliance Part I
Following the promulgation of Singapore’s national laws and regulations, amandatory ship-specific DMLC Part I2has been prepared by MPA to replace thetransitional DMLC Part I.As part of the implementation of the MLC, the replacement of the transitionalDMLC Part I with the mandatory DMLC Part I will be at no charge. The shipowner’sappointed manager in Singapore will be notified accordingly for the collection of thismandatory DMLC Part I to replace the transitional DMLC Part I.Beginning from 01 April 2014, a fee of $70 will be charged for the issuance ofthe mandatory DMLC Part I. For the replacement of DMLC Part I due to loss orreissuance due to amendments of ship details, this will be charged at $74.90(inclusive of GST).
Maritime Labour Certificate
For Singapore ships that already possess a Statement of Complianceonboard, the existing DMLC Part II on board will not be affected by the replacement ofthe transitional DMLC Part I with the mandatory DMLC Part I. There is no furtherneed to replace the existing DMLC Part II for such ships. Shipowners are to obtain aMaritime Labour Certificate from the appropriate RO by 31 March 2014.
For Singapore ships that currently do not possess a Statement of Compliance,they are to undergo the full process of verification by the RO, in order to obtain theMaritime Labour Certificate.
The mandatory DMLC Part I, DMLC Part II and Maritime Labour Certificateare to be carried on board applicable Singapore ships from 01 April 2014 onwards.Recognising the practical difficulties in placing original certification on board existingSingapore ships by 01 April 2014, MPA will institute a grace period up to 30 June2014. During this period, MPA will accept scanned copies of the mandatory DMLCPart I and the Maritime Labour Certificate, together with the original Statement ofCompliance, as fulfilling the carriage requirement
