BIMCO‘s Hold Cleaning/Residue Removal Clause for Time Charter Parties has been revised to take into account amendments to MARPOL Annex V that came into force on 1 January.
The revised Clause, which is referred to as the “2013” edition, has been amended to take into account the disposal of cleaning agents and additives used for hold cleaning which may be harmful to the marine environment (HME). The correct disposal of cargo residues and hold washings is already covered by the provisions of the Clause and has not been amended.
A Special Circular has been issued (No.6 dated 18 July 2013) which provides a summary of the key changes to the Clause. BIMCO members are strongly recommended to incorporate the 2013 edition of the Hold Cleaning Clause in place of the previous version to ensure that the HME issue is properly addressed in their time charter parties.
