After twelve years, the legal battle over the fatal explosion on the "MSC Flaminia" has concluded with a settlement. The Stolt-Nielsen Group agreed to pay up to $290 million in compensation, acknowledging partial responsibility for the accident.

Stolt-Nielsen reported today that the Court of Appeals has affirmed by two to one, in all material respects the ruling on liability from 2018 by the US District Court for the Southern District of New York regarding the 2012 incident on board the MSC Flaminia. Stolt Tank Containers BV has been found at fault together with Deltech for 45% and 55%, respectively.

After a New York District Court decided on September 10 that, Stolt and Deltech are responsible for the explosion and losses of the MSC Flaminia fire on July 2012, which killed 3 crewmembers, Stolt expressed its disagreement with the ruling. The court noted that Stolt has 45% responsibility, while Deltech is responsible by 55%.

The European Commission presented the new EU operational guidelines for ships in need of assistance. Work on these guidelines started following the MSC Flaminia incident when a fire broke out on board a German-flagged vessel, which was subsequently left adrift on the high seas for weeks until Germany agreed to allow the stricken ship to enter its territorial waters.
